NHS glues my head together from st christopher's camden hostel luggage rack smash





i compile this data as a notice for consumer protection and to call attention to the injustice of being smashed in the head and forced to front my own medical bills which as an unempoyed american feels quite SICKO.
as you can see from the correspondence, trails of incompetence and obscuration.
also note that could i have afforded medical treatment i would have done everything in my means to preserve my health and get to the bottom of this.

st christopher's camden boss nick evan fronted me 10 british pounds to get to the clinic.
i was dazed.
he instructed the cabby.
i waited hours for treatment.
a fellow patient took the pics.
a london physician who i saw when i revisited the clinic 24 december 2010 said i likely had a concussion with internal bleeding.  he said wait a few weeks.  i was in pain long after that and felt like a part of my brain was irrevocably altered.
the swedish attending physician said that i had internal bleeding, but refrained from radiation of deeper tests, a move which i now deeply feel sorry about.
if the NHS of england had given me tests the risk of the radiation they said would outweigh the benefit of knowing the extent of damage.
i however feel that the damage was so severe that the sacrifice of radiation would be mitigated by understanding what i already knew, that the blow was so hard to my skull that i did indeed receive brain damage.
that i was high IQ to start with is a blessing.
or that the brain exhibits neuroplasticity and regeneration in the face of injury. 

notice how neil wyborn of the insurance firm blames me.
after the accident the hostel removed the broken hydraulic levers which were meant to hold up the luggage cases to remove convincing evidence that their staff had left this broken equipment in the youth hostel in defiance of the hotel innkeepers act which demands safety and working equipment.

I can confirm that we have had an opportunity to investigate liability in this matter.

I must make it clear that when claims are submitted to us for consideration there is no automatic right to compensation. What must be shown is that our insured were in some way negligent, or had breached a statutory duty. In this case the Occupiers Liability Act will apply. The Act places a ‘common duty of care’ on occupiers. In this case the occupier is our insured, and the duty benefits visitors, such as you. The important part of this Act is section 2(2) which states:

“The common duty of care is a duty to take such care as in all the circumstances of the case is reasonable to see that the visitor will be reasonably safe in using the premises for the purposes for which he is invited or permitted by the occupier to be there.

I have taken the various elements of this claim into account in coming to my decision on liability.

My investigation has shown that you had identified that the support arm of the luggage cage was not working, and you decided to fix it yourself. You placed your head inside the cage but failed to support the lid, which fell shut. Without the support arm in place, it is foreseeable that it might do that.

I am afraid that our insured cannot be held responsible for your actions in the circumstances.

Accordingly, while I have every sympathy for you and regret that this incident has occurred, I do not believe that the incident was caused by any fault on the part of our insured, and we have no offer of compensation to make to you.

However, you are of course entitled to legal advice and if you still wish to pursue your claim I recommend that you seek the advice of a solicitor who will be able to give you an objective view as to the merits of your claim, and advise you how you might wish to proceed.

i do not appreciate how slowly your companies have proceeded or the fact that
they have ignored my claims and failed to update me of the status.

i would appreciate it in the future if you would give me a complete and
exhaustive detailing of what your company does other than delay.

as for inappropriateness, i consider it inappropriate to overbill me and for me
to pay out of pocket medical expenses and to receive scarce communications
regarding your liability.

it is unethical for you not to accelerate the process and communicate clearly
and promptly.

the injury to my person was a near lethal assault causing immense pain.  if i
had died following the event, you would not be delaying, you would suffer
criminal investigation.

there were several witnesses as well as a tampering with the evidence, removal
of the broken component, rudeness on the part of the staff, and hours i spent at
hospital, all with no recompense and scarce communication.

if someone you loved received such a lifethreatening blow to the head as did i
you would demand swift justice.

to take advantage of me as i was medicated in pain and underrepresented is the
height of corruption.

please communicate with me, and do not leave me hanging, convinced of your
company's despicable character.

rude staff and delinquent assistance towards my medical needs?

i spent several thousand kronor for the neurologist report and had weeks of my life ruined in extreme pain, followed by recurring headache and persistent throbbing in the front of my braincase under my skull.

you would never wish such a hard crack on the skull of any human being, especially a loved one.

there seems to be an unusual delay and failure to communicate with me.

at the time of the accident i attended the warren street A&E on the 22, and the 24th december

since then i spent 2000 kronor on swedish karlinska institutet in stockholm for the ongoing headache.
i have a comprehensive report form the neurologist here who thinks a hematoma was likely.
the neurologist in UK said i was experiencing post concussion syndrome.

i also have a very disfiguring scar.

the luggage case was a very heavy unwieldy thing with a broken hydraulic prop.  

so that i might benefit from its anti-theft feature, i decided to try to see how to make it stay open, without crashing down.

as i sat down to attempt to fix or reinstall the broken prop, without which he case is uselessly having the heavy top slam down, the case fell on my head.


two cases were similarly broken in the room.

st christophers removed the broken arm prop ( much as a hood of a car would have) after the accident because they realized it provides evidence of their negligence, but i have photographs

i may be sending several months in stockholm to job seek.

but please consider the life threatening nature of this blow, the extreme crack to my head resulting in a month long headache,  spurting blood, nausea, a scar,  the time i have had to research and write letters, my swedish medical expense as a non-citizen, and the extreme confusion it has caused me to be in so much pain for my entire holiday and the fact that st christophers even overbilled me, when i wasted 8 hours at the clinics on three occasions.

such that really, my time is valuable to me and my health.


these cases are heavy and of poor design and broken, and used to deter theft.

i promptly moved to another hostel, where the lock on my locker was cut and my eyeglasses stolen value 600$

which i moved to get away from the scene of the accident and the rudeness shown me by st christophers.


i appreciate all efforts to cause the management to be more respectful towards the health and safety of the guests and have a proper procedure for accident and better human relations and better maintenance to protect against liability in the future.

proper prevention would have protected me from an embarrassing scar and the pain i have suffered and the ongoing headache, which may bother me for a long time, as i stay awake nights still with throbbing in the front of my brain.

if it is necessary for me to travel back to england to be evaluated extensively there, i will.


as your company might assess a a sum towards the negligence----i am the one that may have long term health consequences.

and while i most certainly Hope for the headaches to go away   and the painful throbbing on my forehead----hoping is not enough.


if you asked me, for what price would you sustain a head blow of this magnitude, i would say none.

this was one of the most fearsome things that ever happened to me, besides being strangled raped or carjacked, which all happened in the usa.

as i regained consciousness, my first concern was braindamage.

i have read news stories of the permanent brain damage boxers endure in their sport, and it was with horror i instantly began to fear (and still fear) the permanent damage to my intelligence, which is to me obviously, priceless.

i write this in tears, as it brings me great distress.

hello there!  mary eng, here.  i have new medical report.  in sweden now and attended medical here at karolinska intitute where i saw a neurologist for the ongoing headaches after the injury at camden st christophers inn 22 december 2010.

my bill to enter the swedish system is 2000 kronor.

the doctor sees ongoing evidence of a concussion.  the potential for hematoma he sees, despite contraindication of radioactivity exposure for MRI.

i have his report, and we can obtain the two reports from the warren street accident clinic.

i am still in pain and must take several doses of ibuprofen every day to deal with the pain.

your case was broken and defective and as i tried to fix the broken latch i was knocked unconscious and bleeding by the heavy case.

i could have been killed or blinded.


as now it is weeks of pain in my head---and a ruining of my trip to europe---what are you doing towards your responsibility for safe and habitable dwelling and towards my medical expenses?

i have a disfiguring and swollen scar on my forehead which i cover now with a hat.

it is embarrassingly ugly.

what is beds and baths going to do about my medical expenses and my ongoing pain?

would you wish this on your daughter or sister?

Further to your complaint i can re-assure that i have refunded the 2 unused nights from your recent stay with us at Camden St Christophers.
You say in your letter that you handed to the bar on todays date, that you used only 2 nights out of the original 5 booked, however i did inform you at the time that any booking requires a 24 hour cancellation period and as you decided to leave within this time period you were also charged for the 3rd night. A refund of £41 was credited to you account from ours on the 24th December 2010.
I have spoken to the credit card company who have assured me that this has happened although it can take up to 10 working days to arrive in your account. Being that the refund was issued on the 24th of December and that the 25th, 26th, and 27th were all public holidays in the u.k. and also noting that Saturday 1st January 2011, and Monday 2nd are also public holidays i would expect your refund to hit your bank around the 5th.
Please contact your card issuer if you require confirmation of this.
Also i would like to ask you to refrain from re-entering the premisies here and would also kindly ask you to direct all correspondance to Murray Roberts who has been dealing with your complaint at a director level since you involved your lawyers and our insurerers.

i stayed 22, 23 december at camden hostel room 8.

i spent two hours of the night of the 22 at A&E due to the defective luggage case which concussed me.

i however i paid for 22,23,24,25,26

nick evans said it would be possible to redebit my account.  so i need to travel to camden to make sure this hapens`/  or can you assure me that it has been done?

i essentially paid 100lbs to be whacked in the head waste 3 hours in clinic, have nick be rude to me, scar my forehead, and waste time writing emails to deal with it.

can you assure me i have the refund of  the nights i moved out, if not the entire sum.
no one will answer the phone at camden.

the first night i was hit on the head by a defective luggage case which caused me a headache for four days and a concussion and a scar on my forehead.

a manager at bath and abars, murray roberts is investigating an insurance claim.

in the meantime i want to be refunded the nights i did not stay at the camden hostel, if not the entire experience which has ruined my holiday with pain.

i thank you so much for your prompt response!

i went to the A&E at warren again today to be reviewed by a doctor. he did
neurological tests, and explained i have post-concussion symptoms, in addition
to the laceration. i have had a persistent headache since the event 48 hours
ago.  there is a feeling of swelling and pressure across the entire front of my
brain.

this is new to me, as i have never had a head injury of this level of impact.

for all our sakes i hope there is no ongoing problem with pain and dizziness or
injury to the brain.

also i think it would be imperative for your company to attend to the damaged
cases as they snap closed and could smash fingers as well.

i look forward to hearing from you.  so far i am thankful the NHS.  i have now
moved to a hostel closer to town, piccadilly backpackers.  it was my
understanding with manager on duty nick evans, that i would be reimbursed for
some nights.  i slept two of the five i paid for approximately 100 UK pounds.

hours of my time towards clinic: 3.

mngr nick evans said that if i had not written my email in documentation of the
event, he could have offerred me a few free nights.  i will check my accounts to
see that the refund processes.

he would not furnish me with a copy of the incident report.

it is important that the safety be secured and my health be attended to.

also if your insurance company would like the emails of the girls who were
present in the room, i have those as well.

they helped me a great  deal to stop the bleeding and get ice and set up
straight.
the other staff who attended was named patrick.

i was trying to fix the broken latch, and figure out how to keep the lid open
when it smacked down upon me.  it is a poor fit and badly designed and it was
broken.

the design is the opposite of ergonomic.

now---this is really crazy  regarding my reservations for the last two nites----


i just found internet to apologize and attempt to rebook for at least two nites in camden if possible

after a seven hour wait in swedish airport yesterday i am rebooked to heathrow.  i might arrive tonight. a@ 10pm.
at this point i have little faith.

if so though, does camden or tower of london st christopher's have a spot for me?  if so, it would be amazing!

he was rude this morning and upset about me writing a letter to his bosses

and said he could have given me a few free nights if i had not chose to make it
a "legal matter" by writing a lettr

the defective hydraulic prop for the heavy huge metal cask is the broken part.

he insists that the case is serviceable---despite being broken and unwieldy.

i am trying to move into another place and may get a partial refund for my
advance pay.

nick was very unsympathetic.

i tried to tell them they should fix the cases, as more than one is broken in
the room.

there is an incident report which he will not give me.

my head is still hurting and even though it is christmas eve i may go again to
A&E to demand more exam.

i was an above average smart person, so because i seem normal to you is not the
same.  i feel like something is different.

boxers who get hit in the head regularly suffer long term brain damage and i am
very worried for it as well as the scar.

nick said there would be no compensation for m time in the clinic two hours
either----
and that by paying the eight quid for the cab---somehow, that is enough.
